So Tuesday night my b/f and I went to these apartments to return a computer to this lady, an dit had taken my b/f about 3 weeks to fix it. Well she was extremely angry and had began calling me about it. So I told her I would have it to her that night. She called several more times. Finally I said quit harassing me, your getting your computer, I'm coming now. Well I dropped my b/f off at the end of the street becasue he didn't want to deal with her. I drove up the road to her apartment and this car was coming down with its headlights off and swerved to hit me. Well I parked the car and got out to take her computer to her and I heard some yelling and saw that it was my b/f and that lady. She had tried to hit him with her car and they were arguing, well I got the computer out of the trunk and took it down there and her son said I threw it at him, okay How am I going to throw a computer at someone standing 2 feet away?? well she got mad got in my face and started yelling and screaming at me then she got a bat and began beating me with it, in my head, my arms wherever she could. Then she grabbed my hair and threw me on the gorund and she and her 3 sons beagn beating me with a bat and kicking me and spitting on me. I felt so helpless. I mean I had nothing to do with it and I get jumped. Its not right. Well the cops and the prosecutor won't do anything about it because they said it was mutual combat, and they didn't know who threw the first punch. Well I have the proof on me...I have nasty looking bruises and cuts all over me. She kicked me right where my Kidney is and thats the worst bruise I have. I had to be taken to the hospital that night. And still they won't do anything...its like so your telling me its okay to go around in the state of Ohio with a bat and beat people becasue you feel like it??
I don't know what to do now.

I can just see Jediskipdogg helping you but you could call to the police on physical assault. But now that would be too late now. :(

She must've had one severe case of computer withdrawal!

You could initiate a civil suit. It will be harder to win without a criminal action against your attackers. Initial consults with lawyers should be free of charge - shop around. Clerks at the courthouse may be able to recommend good representation.
I'm not suggesting this will be fun at all - or profitable, but you may get some satisfaction.

I cannot offer any advice, but I am sorry this happened to you. That would be very scary. I hope you can make it right, and glad you are OK.

I'm sorry Nicole. How terrifying, like you said. It sounds like you didn't "sell" your case to the police. I have so many thoughts on how people could have been thinking, etc., but it's all speculation. For my own satisfaction, I'll talk to my little brother about this; he's a family law attorney who always gives good general advice on about any topic. If I get any good tips, I'll sure send them your way. Sending you hugs and sympathy.

So sorry you went through such an ordeal but glad you didn't end up in hospital!
It is quite unsettling to know such a person is out there, loose. She needs anger management courses! I get mad at times, I get upset, sometimes I'm right too to be angry and upset... but I don't beat people up with a baseball bat :eek: What a sicko! What next??! She will strangle someone over a parking space...?
One thing I've noticed these last few years : people's intolerance. Many go about their day as if the road is theirs... as if the world is theirs... and move out of the way...!! The entire world owes them. They are entitled to everything and anything. Common sense has died a long time ago.
Like Evermont said, I'd initiate a civil suit.

Hmmm...not sure I wouldn't just want that person out of my life FOREVER.. I can understand how aggrieved you are and that she should pay societies price for her violent behaviour... but if that is how she reacts to that... what else might she do? It's not like you have gotten much help from the law so far.. if it were me I would be keeping the ***l away from those people

Does your BF know this lady from somewhere? My son fixes computers but he works for a company to do so. Id show the PD all the phone calls she made to you, you can get a record of calls made. Make sure you take photos of any injuries and get a copy of what the hospital noted about your injuries too. Good luck to you.

Did she have marks on her? either way you need to go up and demand to speak to the Cheif of police and ask why charges was not filed on her. Tell them YOU want to file charges.
I'll ask my husband tomorrow( he is a Deputy) but in the mean time I would call the Cheif or Sheriff and tell them you want to know why charges was not pressed expecially if she has not marks but you ended in the hospital.

A my department, we will not arrest on an assault unless the act is viewed by the officers on scene. It has to be happening when officers view it. We take a report and refer the victim to the prosecutor office. However Felonious Assault we will arrest even if we did not view the offence, and you have to be assaulted with a deadly weapon and spend some time in the hospital.
Do they know you went to the hospital?
And after 18 years in Law Enforcement, there is always at least 2 sides to every story.

I want to file a civil suit against her, but i don't know what to do and its probably a waste of my time.
No my b/f doesn't know her from anywhere, he just worked on her computer after she called him about it. And if she gave it to him to take home and work on can she report it stolen to the police if he did not phsyically walk in her house and take it without her permission??

where was your bf during all of this?? And why didnt' he want to deal with her... he was doing the work on the machine, and he couldn't go talk to her himself? I dont get that...
Did he just stand there and watch or what? You didn't say much about where or what he did about it... is he not a key witness to the assault?

Find a good lawyer, let them decide if it's a waste of time!
If she called your b/f there will be a record of that call. Anyone can report anything stolen, but there are penalties for filing false police reports. So go ahead and hope she does that, she may get in trouble for it.
File a police report. Seek an ex parte TRO. Find a good attorney.

Not sure about Ohio laws, but that's what concealed weapons permits are for.
Like they say, never take a baseball bat to a gunfight. Or was that a sword.....

My boyfriend was there. He was trying to get to me to get her off, but the boys stepped in and blocked him, the one boy punched him pretty hard in the face, we think he may have had a concussion. He has problems with his ear now. He eventually got over to me and picked me up and took me to the car.
there really wasn't much he could do, there were three boys against him. They were beating the sh** out of him the same time the woman and her son were getting me. It was all 4 of them against me at one point until my b/f tried to step in and get her off me.

Well that REALLY sux!!
As far as I know, YOU have the RIGHT to march right on down to the PD and file charges against these people, Nicole!! You've got you AND your B/F who were assaulted, and at least you who have bruises to prove it! Get all your documentation from the hospital, make sure you've got photos of your injuries, get the phone company reports of the calls she made, etc., as was already suggested. and GET A LAWYER!!
That just ain't right! I'm sorry! People do NOT have the right to run around beating the living h*LL out of others like that!! I also always thought that a BASEBALL bat was considered a deadly weapon. You CAN easily KILL someone with one!!
