Hello there, my name is Ian from Darlington. I have been diagnosed with type 1 diabetes for about 18 months. In June i had a hypo while i was at work and had to go to the hospital. On return to work, i had to see the works doctor who put me on a three month medical suspension. after two month my doctor said i was now capable of returning back to work and informed my employees of this. I was called into work last week and was told my contract was terminated due to my condition. Ive been told i can appeal against it of which i am doing. I have summerised this situation very briefly with the main points. I would be grateful if anyone has been in a similar position or know of any other similar cases relating to this. Any help or guidance would be grateful.
The ADA has a legal department that may have some advice.
Discrimination - Advocacy & Legal Resources - American Diabetes Association (http://www.diabetes.org/advocacy-and-legalresources/discrimination.jsp)
They also have state-by-state laws listed regarding diabetes.

That sounds like constructive dismissal to me. It is the first time I have heard of a medical suspension from work because of a hypo. And if it was the work doctor who did this ... :hmmmm:

That's unfair. Unless you work at a place that demands that you are not a diabetic. For instance, if you are a surgeon or a crane operator etc, you can't have a hypo!

Somehow, Darlington does not sound... American.
Perhaps there is a corollary organisation in the place that Darlington is?
I presume Darlington is in UK?
I seriously question whether anything American these days has any panache in the world, what with our emerging communist rulership. Yes, politics, fer shure - these things are too shameful to own, I say.

Hey, Dan, I live in Wisconsin and there's a Darlington here. However, I suspect that the original poster does not live there. This is one reason I get irritated when people don't post their location nor what type of diabetes they have. It makes a difference in the advice given. Now, back to the issue at hand. If the facts as stated are correct, then there is blatant discrimination going on and he should take legal measures.

Hi Darlo & Welcome.........
Although this forum is based in the USA, doesn't mean you still can't be a member. There's many UK members that belong to this forum, so maybe a few will chime in with some help.
